Terms and Conditions

1. Definitions

  • “FundKapital” refers to FundKapital S.A.P.I. de C.V., the company operating the platform.
  • “Host” refers to any individual or legal entity that offers lodging through platforms such as Airbnb or Booking.com and uses FundKapital services.
  • “Advance” refers to the amount disbursed by FundKapital to the Host as an advance on future confirmed reservations.
  • “Platform” refers to the FundKapital website and application.
  • “Eligible reservation” refers to a confirmed reservation on Airbnb or Booking.com that meets FundKapital’s eligibility criteria.
  • “Fee” refers to the charge FundKapital applies for the advance service, expressed as a percentage of the advanced amount.

2. Service Description

FundKapital provides a digital factoring service that allows vacation rental Hosts to advance up to 90% of the value of their confirmed reservations. The service works as follows:

  1. The Host connects their Airbnb and/or Booking.com account to the Platform.
  2. FundKapital syncs confirmed reservations and evaluates their eligibility.
  3. The Host selects the reservations they want to advance and requests an Advance.
  4. FundKapital evaluates the risk and, if approved, deposits the Advance into the Host’s bank account.
  5. When the lodging platform pays the Host for the advanced reservation, FundKapital collects the Advance amount plus the corresponding Fee.

3. Eligibility

To use FundKapital services, the Host must:

  • Be at least 18 years old and have legal capacity to enter into contracts.
  • Be a tax resident in Mexico.
  • Have at least one active Airbnb and/or Booking.com account with reservation history.
  • Successfully complete the identity verification process (KYC).
  • Provide a valid bank account in their name to receive deposits.
  • Accept these Terms and Conditions and the Privacy Notice.

4. Advance Process

4.1 Request

The Host may request an Advance by selecting Eligible Reservations on the Platform. Each request will be evaluated by our scoring system, which considers the Host’s profile, reservation history, time until check-in, and other risk factors.

4.2 Approval

FundKapital reserves the right to approve or reject any Advance request at its discretion. Approval is not guaranteed. If approved, the Host will receive the specific Advance terms (amount, fee, term) for acceptance.

4.3 Disbursement

Once the Host accepts the terms, FundKapital will deposit the Advance amount into the registered bank account within 24 business hours.

4.4 Collection

Collection of the Advance plus the Fee will be carried out automatically when the lodging platform processes payment of the advanced reservation to the Host.

5. Fees

The Fee for the Advance service is determined at the time of approval and depends on the following factors:

  • Time between the request and the reservation check-in date.
  • The Host’s profile and history on the Platform.
  • Total amount requested.
  • The reservation’s cancellation policy.

Fees generally range between 8% and 12% of the advanced amount. Please refer to the Costs and Fees page for detailed and up-to-date information.

6. Reservation Cancellations

If an advanced reservation is canceled by the guest:

  • If the cancellation policy generates a partial payment to the Host, FundKapital will adjust the amount owed proportionally.
  • If the cancellation results in a full refund to the guest, the Host must return the Advance amount to FundKapital within 15 calendar days.
  • FundKapital may deduct pending amounts from future Advances or payments.

7. Host Obligations

  • Provide truthful and up-to-date information at all times.
  • Keep their connected lodging platform accounts active.
  • Not intentionally modify or cancel reservations that have already been advanced.
  • Notify FundKapital of any change in their data or circumstances that may affect the service.
  • Comply with tax obligations arising from their lodging income.

8. Limitation of Liability

FundKapital shall not be liable for indirect, incidental, or consequential damages arising from the use of the Platform. FundKapital does not guarantee uninterrupted availability of the Platform or the approval of Advance requests.

9. Intellectual Property

All intellectual property rights related to the Platform, including trademarks, logos, designs, software, and content, belong to FundKapital or its licensors. Reproduction without authorization is prohibited.

10. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the United Mexican States. For the resolution of any dispute, the parties submit to the jurisdiction of the competent courts of Mexico City, waiving any other venue that may otherwise apply.

11. Modifications

FundKapital reserves the right to modify these Terms and Conditions at any time. Changes will take effect upon publication on the Platform. Continued use of the service after publication of changes constitutes acceptance of the new terms.
